Introduction to

Copyright

Copyright protection provides creators with legal rights over their original works.  These rights allow creators to control how their works are used and distributed, and they typically cover a wide range of creative works, including literary works, artistic works, music, films, and software.

Copyright protection is automatic upon the creation of the work and does not require registration. Some countries also provide systems to help evidence ownership, but this is not required in the UK or Europe.

The benefits of copyright protection include:

  • Exclusive Rights: The right to control reproduction, distribution, performance, and other uses of the work.
  • Economic Benefits: Copyright can support commercial activities when handled appropriately through contractual arrangements.
  • Moral Rights: In many countries, creators retain moral rights, including the right to be identified as author and object to derogatory treatment of the work.

Copyright protection typically lasts for the life of the author plus 70 years in the UK and Europe, though some categories (such as sound recordings) differ.

Designs used in products may instead (or additionally) be protected under UK or EU design law, which often provides a more appropriate route for safeguarding commercial assets. See our separate note on Designs.

How to obtain and appropriately manage copyright

Copyright is automatic, but creators can take practical steps to support and demonstrate ownership:

  • Creation of original work: ensure the work is original and fixed in a tangible form (e.g. written down, recorded, or saved on a computer).
  • Documentation: keep clear records drafts, or timestamps demonstrating the creative process.
  • Use of copyright notices: not required legally in the UK, using copyright notices, including the © notation, the copyright owner's name and the year of creation of the work, can signal rights and deter misuse.
